On July 12, 2021, NAR submitted a comment on the Housing and Urban Development (HUD)’s interim final rule, Restoring Affirmatively Furthering Fair Housing Definitions and Certifications. The interim final rule, which takes effect on July 31, restores definitions from HUD’s 2015 Affirmatively Furthering Fair Housing (AFFH) rule that HUD repealed with its 2020 AFFH rule. The interim final rule also restores technical assistance for communities engaged in fair housing planning that HUD had withdrawn. NAR wrote that the 2015 definitions, which this interim final rule restores, better reflect the goals of the Fair Housing Act as written by Congress and interpreted by the courts.
