CALL TO ORDER
The meeting of the Association Executives Committee Association Mediation Work Group was called to order at 1:00pm by co-chair Patrick Reilly.
OPENING REMARKS
Co-chairs Patrick Reilly and Sandy Naragon welcomed work group members and allowed time for participant introductions.
SUMMARY OF MEETING DISCUSSIONS
The work group discussed their expectations and additional information to consider to fulfill the purpose of developing a mediation procedure and ombudsman program to assist associations in resolving disputes. Such considerations include:
- Create messaging that is encouraging relative to mediation being efficient and effective in resolving disputes.
- Consider asking associations that have successfully mediated if they are amenable to providing testimonials.
- Determine criteria for who may serve as an ombudsman and mediator.
- Develop criteria or guidelines that assist ombudsmen and mediators in maintaining their knowledge and skills.
- Consider adopting one mediation policy procedure for all disagreements between association to association disputes.
- Consider developing case interpretations that highlight the types of disputes that can be mediated between associations or referred to an ombudsman.
SUMMARY OF NEXT STEPS
To assist the work group in fully vetting the aforementioned considerations, NAR staff is to provide the following information:
- Review the survey from the 2017 REALTOR® Association Collaboration Work Group to determine whether disputes that inhibit associations from collaborating were identified. (This information was not included in the survey results.)\
- Survey mediators (mediators available to mediate NAR’s association jurisdiction changes and name changes) about their pain points and/or difficulties with the mediation process, so the work group can determine whether best practices should be established.
- Gather information on other comparable mediation programs and their processes.
